Basic Will (children)
Who might it be appropriate for?
The "Basic Will (children)" is only applicable where there is no
surviving spouse and you wish to leave your estate to your children
in equal shares.
What does this basic option provide for?
An outline of the contents of the Basic Will for a widow or
widower wishing to provide for their children is as follows:
- previous testamentary acts are revoked;
- a clause dealing with the order of deaths;
- the appointment of your children as executor; and
- the executors hold the estate to be divided equally amongst the
children provided that if a child predeceases leaving children,
then those children take their parent's shares equally.
