Checklist – Will with full discetionary trust
The information requirements for a Will involving testamentary
trusts that are full discretionary trusts will be the same as the
appropriate Basic or Standard Will Types together with details
for the full testamentary trust to be formed.
In relation to the formation of testamentary trusts, the three
key elements to be decided are:
- who is to be the Trustee of the trust;
- the range of beneficiaries who can benefit from the trust;
and
- who is to be the Appointor of the trust.
